1. Introduction
1.1 This Warranty Policy ("Policy") explains the warranties that apply to Goods supplied by Elevate Tech Limited ("Elevate Tech", "we", "us" or "our"), and the limits of those warranties.
1.2 This Policy forms part of, and must be read together with, our Terms and Conditions of Sale and Website Use, our Returns and Refunds Policy, our Product Safety and Installation Disclaimer and our Disclaimer and Limitation of Liability Policy.
1.3 Our customers are primarily business customers. This Policy applies in addition to any rights you may have under applicable law, including the Consumer Protection Act 68 of 2008 ("CPA") to the extent that it applies. Nothing in this Policy excludes, limits or restricts any right or remedy that cannot lawfully be excluded, limited or restricted.
2. Definitions
2.1 In this Policy:
"Goods" means any product, component, part or item supplied by Elevate Tech;
"Manufacturer" means the manufacturer or brand owner of the relevant Goods;
"Manufacturer Warranty" means a warranty (if any) provided by the Manufacturer in respect of the Goods, on the Manufacturer's standard terms;
"Safety-Critical Component" has the meaning given in the Terms and Conditions of Sale and Website Use.
3. Manufacturer Warranty Only
3.1 Elevate Tech provides the Manufacturer Warranty only. Where the Manufacturer of the Goods offers a warranty, we pass that warranty through to you on the Manufacturer's standard terms, to the extent that the Manufacturer permits.
3.2 Elevate Tech does not provide any separate, additional or independent warranty beyond its statutory obligations, unless we have expressly agreed otherwise in writing. Any statement, specification or representation made by Elevate Tech is not, and must not be construed as, a warranty unless expressly described as such in writing and signed by an authorised representative of Elevate Tech.
3.3 The duration, scope, terms, exclusions and remedies of a Manufacturer Warranty are determined by the Manufacturer and vary by product and brand. Where available, Manufacturer Warranty details are provided with the Goods or on request.
4. Scope and Limits of the Manufacturer Warranty
4.1 A Manufacturer Warranty typically covers defects in materials and workmanship under normal and proper use, for a defined period, subject to the Manufacturer's conditions.
4.2 A Manufacturer Warranty typically does not cover, and Elevate Tech accordingly does not accept responsibility for:
(a) fair wear and tear; (b) defects or damage caused by improper, unqualified or non-compliant installation, integration, commissioning, wiring or configuration; (c) defects or damage caused by misuse, abuse, neglect, accident, or operation outside the Manufacturer's specifications or ratings; (d) defects or damage caused by incompatible application, incorrect selection, or use with unsuitable or incompatible equipment or components; (e) defects or damage caused by unauthorised modification, alteration, repair or tampering; (f) defects or damage caused by improper storage, handling or transport after delivery; (g) defects or damage caused by environmental factors, power surges, load-shedding, voltage irregularities, water ingress, corrosion or contamination; (h) consumable or wear parts beyond their expected service life; and (i) any Goods from which serial numbers, batch numbers or identifying marks have been removed, defaced or altered.
4.3 Safety-Critical Components. Because Safety-Critical Components must be selected, installed, commissioned, inspected and maintained by qualified professionals (see the Product Safety and Installation Disclaimer), any warranty (whether the Manufacturer Warranty or a statutory right) is conditional on the component having been handled, installed and used in accordance with all applicable laws, standards, codes and Manufacturer instructions. A warranty claim may be declined where there is evidence of improper or unqualified installation, integration or use.
5. Making a Warranty Claim
5.1 To make a warranty claim, contact us at support@elevatetech.biz with your Proof of Purchase, a description of the defect, the date the defect was discovered, and (where possible) photographs and supporting information.
5.2 We will review the claim and, where appropriate, liaise with the Manufacturer. We may require the Goods to be returned for inspection in accordance with the Returns and Refunds Policy. The Goods may be assessed by us or the Manufacturer to determine whether the defect is covered.
5.3 Where a warranty claim is valid, the remedy (repair, replacement, or refund) is determined in accordance with the Manufacturer Warranty terms and, where applicable, your statutory rights. Where the Manufacturer Warranty provides for repair or replacement, that remedy is provided in accordance with the Manufacturer's process and timeframes.
5.4 Where, following inspection, a claim is found not to be covered (for example, because the defect resulted from improper installation or misuse), we will inform you, and any return, repair or replacement will be subject to applicable charges and to the Returns and Refunds Policy.
6. Statutory Rights (Consumer Protection Act)
6.1 Where the CPA applies to you, sections 55 and 56 of the CPA may entitle you to goods that are reasonably suitable for their purpose, of good quality, in good working order and free of defects, and to return goods that fail to meet these standards within 6 (six) months of delivery for repair, replacement or refund, at your election, subject to the CPA. The implied warranty of quality under the CPA, where it applies, is in addition to the Manufacturer Warranty and any other right in law.
6.2 The CPA generally does not apply where you are a juristic person whose asset value or annual turnover, at the time of the transaction, equals or exceeds the threshold determined under section 6 of the CPA. Where the CPA does not apply, the Manufacturer Warranty and the common law govern, subject to the limitations in our Disclaimer and Limitation of Liability Policy.
7. Exclusion of Implied Warranties (Where Permitted)
7.1 To the maximum extent permitted by law, and except for the Manufacturer Warranty and any rights that cannot lawfully be excluded (including, where applicable, under the CPA), all warranties, conditions, representations and terms, whether express or implied by statute, common law or otherwise, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, compatibility or non-infringement, are excluded.
7.2 Goods, and all Technical Data and product information relating to them, are otherwise supplied on an "as is" and "as available" basis, as further described in the Product Safety and Installation Disclaimer and the Disclaimer and Limitation of Liability Policy.
8. Limitation of Liability
8.1 Elevate Tech's liability in connection with the Goods and any warranty is subject to, and limited by, the Disclaimer and Limitation of Liability Policy and the limitation provisions of the Terms and Conditions of Sale and Website Use, to the maximum extent permitted by law.
9. Amendments
9.1 We may amend this Policy from time to time. The updated version will be published on the Website with a revised "Effective Date" and "Version". The version applicable to a Manufacturer Warranty claim is the version in force at the date the relevant Order was placed, without affecting the Manufacturer's own warranty terms.
10. Governing Law and Dispute Resolution
10.1 This Policy is governed by the laws of the Republic of South Africa.
10.2 Any dispute arising from this Policy is subject to the dispute resolution and jurisdiction provisions of our Terms and Conditions of Sale and Website Use (negotiation, then mediation, then arbitration in Cape Town under AFSA rules, with the non-exclusive jurisdiction of the Western Cape Division of the High Court), without limiting any statutory right you may have.
